Construction Contracts

The most important part of any relationship is making sure that it is built on solid foundations.  In the construction industry this translates to the contractual documentation.

It is important that such documentation represents and serves your best interests.  The Clarkson Wright & Jakes Ltd Construction Contracts Team is familiar with the JCT, FIDIC, NEC and other standard form contracts and, using this knowledge, we regularly advise our clients and negotiate on their behalf in order to meet their objectives.  Our Team recognises that the key to a successful contract is anticipation of potential problems or difficulties that may arise so that the proper contractual procedures are in place to address this.  The best time for these procedures to be agreed is prior to the commencement of the construction project when the parties’ interests are aligned.  Where the construction project concerns property, we work closely with our Property Development Team to ensure you receive the necessary property advice for the deal.

On most construction projects the client will require advice from a multitude of professionals (in addition to the legal profession) and our Team is able to prepare and negotiate the contractual documentation relating to the appointment of those professionals.  We have extensive relationships within these professions and are therefore able to liaise and build on this to your benefit.

Our expertise includes the following:
  • Advice and interpretation of construction contracts;
  • Negotiation of changes to construction contracts;
  • Advice, drafting, interpretation and negotiation of contracts appointing other professionals;
  • Site procurement and disposal;
  • Drafting of ancillary documentation such as Letters of Intent, Guarantees, Warranties, Collateral Warranties, Novation Agreements, Assignments and Purchaser/Supplier Agreements.

Many of our Team are recognised by Chambers & partners, publishers of the world's leading guides to the legal profession. You can read what they say here.
