HIGHLIGHTS
Currently Jill is acting in a claim for breach of warranties in an agreement following the sale of a business. The claim is for a sum in excess of £500,000. Jill was able to obtain security costs for her client in the form of a bank guarantee following an application to the court.
A recent case concerned a shareholders' agreement prepared by one of the shareholders, a solicitor who had also recently acted for the company. Onerous obligations were placed on two shareholders. A case was put forward on their behalf that the shareholders' agreement was unenforceable and should be set aside on the basis that the solicitor was in breach of his fiduciary duty. Negotiations were entered into and the matter was concluded to our client's satisfaction.
In court proceedings commenced by our client for an unpaid invoice in which Jill acted, the Defendant counterclaimed for breach of contract for a sum in excess of £600,000. The Defendant failed to particularise its counterclaim adequately and an application to strike out the counterclaim was made. Ultimately following criticism from the judge considering the matter the Defendant discontinued its counterclaim and paid a contribution towards the Claimant's costs.
Jill recently acted for a client in connection with a claim that concerned an allegation that a customer had been discriminated against on the grounds of race. Following a detailed response denying that the customer had been discriminated against and disputing the factual background, the customer did not proceed further with the claim.
