Defamation (Libel and Slander)

Of course, publication of defamatory statements can be made in many forms. Owing to the surge in the popularity of social media, with an estimated 1 billion people being connected by social networking, there has been an increase in the number of defamation claims made which relate to statements made on blogs or other social media sites.

Libel covers a statement which is made in a permanent form, such as in a newspaper, on the radio or TV or on a website or blog.

Slander covers a statement which is made for example by spoken words.

In both cases, there is a time limit of 1 year from the date of publication for making a claim. Taking advice at an early stage is therefore crucial.

Defamation claims must be pursued in accordance with the provisions of the Pre Action Protocol for Defamation claims and with the provisions of the Defamation Act in mind. At CWJ we have a specialist team who are able to provide clear, robust and realistic advice to both claimants and defendants.
