Disabled Boy Compensated for Road Crash Before His Birth

The 17-year-old was born with cerebral palsy and is confined to a wheelchair. His mother was heavily pregnant with him when she was injured in the crash, suffering a broken leg. His father, who was at the wheel, had no insurance. Lawyers on the boy's behalf therefore launched proceedings against the Motor Insurers' Bureau, the industry body that compensates victims of uninsured motorists.

The central points of dispute in the case were whether he had been injured in the womb as a result of the accident and whether that was the root cause of his disabilities. However, a trial of those difficult issues became unnecessary after his legal team succeeded in negotiating a settlement of his case.

The amount of compensation payable was kept confidential but, in approving the settlement, the High Court noted that it would be sufficient to ensure that the lives of the teenager and those who cared for him would be much easier in the future.

Compensation can never make up for the loss of health and independence that can result from serious accidents.
