A man who developed severe back pain while working as a mechanical maintenance engineer has achieved a settlement of his claim against his employer.
The man's work involved lying underneath heavy machinery and twisting his body in order to carry out maintenance work. After he developed back pain, he brought a personal injury claim, contending that his working conditions posed a foreseeable risk of injury and that his employer had failed to provide a safe working environment.
He underwent a medical examination, and although an MRI scan showed pre-existing degeneration in his back, the surgeon who examined him concluded that there had been a four-year period when his back pain was caused by his working conditions, with any subsequent pain likely to be attributable to his pre-existing injuries.
His employer admitted liability and, following negotiations, a settlement of £10,000 was agreed.
