Compensation has been secured for a boy who suffered life-changing injuries as a baby due to a lack of oxygen supply to his brain.
The boy contracted bronchiolitis when he was just five weeks old. He was admitted to hospital and had to be intubated. The tube became dislodged while he was being moved and he was deprived of oxygen for 45 minutes, as a result of which he suffered brain damage and a collapsed lung.
After his family sought legal advice, evidence was obtained from medical experts showing that he should have been reintubated much more quickly and that this failure had caused the injury to his brain. A claim was brought against the NHS trust responsible for the hospital, which admitted liability. A significant interim payment was secured, and he was able to move into a specially adapted home.
A settlement was reached consisting of a lump sum and annual payments for life to cover the costs of his care.
