Tenant Secures £45,000 Damages for Damp and Mould Exposure

A woman whose health was significantly affected by damp and mould in her home has obtained damages.

Her local authority landlord failed to keep the property in good repair, and as a result she was exposed to damp and mould for a number of years. The property also flooded at one point. She repeatedly contacted the local authority in an effort to have repairs carried out, but the local authority did not take sufficient action. The issues with her property led to her developing asthma and aggravated her existing post-traumatic stress disorder.

She sought legal advice and commenced a claim for damages. The local authority admitted liability, accepting that it had failed to maintain the property in a habitable condition.

Following negotiations, a settlement of her claim for £45,000 was reached.
