Advising international organisation on the dismissal of a UK and European Managing Director. Working closely with cross border advisers, stakeholders and financial advisers to conclude dismissal from the UK and European business. Settlement of claims in the region of £200,000.
Whistleblowing and Discrimination
Acting for an employer in defending claims of whistleblowing, sex discrimination, harassment and unfair dismissal. Successful defence of all claims in the Employment Tribunal resulting in withdrawal of claims without payment of compensation.
Advising partnership on dispute with co-partner. Successfully negotiating settlement of claims including discrimination and breach of contract worth in excess of £100,000.
Sexual Harassment, victimisation, bullying and harassment
Defending employer against claims of sexual harassment, victimisation, bullying and harassment in excess of £150,000. Successful negotiation of settlement with significant reduction in value of the claim.
Self Employed Teaching Staff /Sub-Contractors
Advising private school in relation to HMRC audit of self-employed teaching staff.
Advising employer in claim made by former employee for disability discrimination, bullying harassment and dismissal. Successfully defending the claim, disputing disability using covertly recorded footage of the employee working despite claims of being too unwell to work.
Race, Sex and Sexual Orientation Discrimination
Acting for a medical practice defending various discrimination claims and succeeding in having the claims struck out with an order for costs in the client’s favour due to the Claimant’s unreasonable conduct.
TUPE transfer and insolvency issues
Advising employer client in a supply chain on insolvency of its customer and the client’s liabilities for in excess of 500 employees on cessation of service contracts. Statutory collective consultation, TUPE transfer and redundancy advice.
Advising employer in relation to proposed changes to their company pension scheme and requisite statutory consultation process.
Advising medical practice about their proposed merger with another practice to include advising on the employee due diligence and consultation with staff about proposed changes post-merger.
Advising an employer client on a claim by a sub-contractor seeking worker status and unpaid holiday pay.
