When an injured person has ongoing medical or care needs as a result of an accident, interim payments can be secured to help meet those needs until their claim for damages is settled. Recently, a man who suffered life-changing injuries after he was run over by a forklift truck at work secured interim payments to help with his rehabilitation while his claim is ongoing.
The man was working at a furniture supplier when the accident happened. The forklift truck ran over his legs and he suffered serious injuries, including broken bones and skin being torn from his legs. He was in hospital for more than four weeks and his right leg had to be amputated above the knee.
He had lived an active lifestyle before the accident, enjoying the outdoors and taking his children and grandchildren on trips. Since the accident, he has had to use a wheelchair and sleep in the living room of his house. He was unable to carry on working.
He sought legal advice and a claim was commenced. Significant interim payments were secured to allow him to access specialist rehabilitation and to buy an accessible home for him and his family.
